Terms of Service

These Terms of Service ("Terms") govern your use of Dr.Vin ("Service"), an AI-powered visual vehicle condition assessment tool. By using the Service, you agree to these Terms.

1. Service Description

Dr.Vin provides AI-generated visual assessments of vehicle condition based on user-submitted photographs. The Service uses computer vision to identify visible damage, wear, and condition indicators. The Service does NOT provide:

• Mechanical inspection or diagnosis
• Certified vehicle appraisal
• Title or accident history verification
• Guarantee of vehicle condition
• Repair quotes or binding cost estimates

The Service does not constitute a vehicle appraisal, valuation opinion, or price guarantee under any state or federal law.

2. Assessment Limitations

Assessments are based solely on the photographs you provide. The AI cannot detect:

• Mechanical defects (engine, transmission, drivetrain, brakes, suspension)
• Structural damage not visible in photographs
• Hidden flood, fire, or frame damage
• Electrical or HVAC system function
• Odometer accuracy (visual correlation only)

Dollar estimates are statistical models derived from industry repair cost databases (CCC/Mitchell labor rates, PDR industry pricing, NAAA condition standards). They are not repair quotes and actual costs may vary significantly based on location, shop, parts availability, and actual condition upon physical inspection.

3. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be accurate, complete, reliable, or error-free.

4. Limitation of Liability

IN NO EVENT SHALL DRVIN, ITS OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ASSESSMENT IN QUESTION.

You acknowledge that you use the Service at your own risk and that the assessment should not be your sole basis for any vehicle purchase, sale, or financial decision.

5. Assumption of Risk

By using the Service, you acknowledge that vehicle condition assessment from photographs has inherent limitations. You agree not to hold Dr.Vin liable for conditions that cannot be detected through visual inspection of photographs, including but not limited to hidden mechanical faults, frame damage concealed by body panels, or conditions obscured by photograph angle, lighting, or resolution.

6. Prohibited Uses

• Relying on the assessment as the sole basis for a vehicle purchase or sale decision
• Misrepresenting the assessment as a certified mechanical inspection
• Uploading photographs containing identifiable individuals
• Using the Service to facilitate fraud or misrepresentation
• Scraping, automating, or bulk-accessing the Service

7. Photo Data

Photos you submit are processed by third-party AI services (Google Gemini) for analysis and are stored on our servers for up to 90 days to support report verification and service improvement. See our Privacy Policy for details.

8. Payments and Refunds

Payments are processed through Stripe. Refunds are generally not available for completed reports, as the AI analysis is performed immediately upon payment. If you believe your assessment contains material inaccuracies, contact [email protected] within 14 days of purchase. Refund requests are evaluated on a case-by-case basis. Reports expire 30 days after generation.

9. Indemnification

You agree to indemnify and hold harmless Dr.Vin and its operators from any claims, damages, or expenses arising from your use of the Service, including any vehicle purchase or sale decisions made in reliance on the assessment.

10. Dispute Resolution and Arbitration

These Terms shall be governed by the laws of the State of Delaware.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as modified by this section. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms, including whether a claim is subject to arbitration (delegation clause).

Fee Allocation: For claims under $10,000, Dr.Vin will pay all AAA filing, administration, and arbitrator fees. For claims over $10,000, fees will be allocated according to AAA Consumer Arbitration Rules.

Location: Arbitration shall take place in the State of Delaware or, at the claimant's election, in the claimant's state of residence.

Small Claims Court: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration. All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of your first use of the Service. The notice must include your name, mailing address, and a clear statement that you wish to opt out of this arbitration clause.

11. No Professional Advice

The Service does not provide professional automotive, mechanical, legal, or financial advice. Reports are informational tools only and should not be the sole basis for any vehicle transaction.

12. Intellectual Property and License

All content generated by the Service, including reports, grades, and assessments, is owned by Dr.Vin. You receive a limited, non-exclusive, non-transferable license to use your assessment reports for personal, non-commercial purposes.

13. Age Restriction

You must be at least 16 years of age to use the Service. If you are under 18, you represent that you have parental or guardian consent.

14. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

15. Force Majeure

Dr.Vin shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to failures of third-party AI services, internet outages, or natural disasters.

17. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dr.Vin regarding the Service.
